1. Introduction

Welcome to AfriTech Labor Company. These Terms and Conditions govern your use of our services, including the provision of construction labor resources from Ghana to Romania. By engaging with our services, you agree to be bound by these terms. If you do not agree, you should not use our services.

2. Services Provided

AfriTech Labor Company specializes in supplying highly skilled construction workers from Ghana for employment in Romania. Our services include the recruitment, training, and placement of workers in various construction fields such as electrical work, plumbing, masonry, and more. The following outlines the key services we offer:

  • Recruitment and selection of qualified workers
  • Worker training programs tailored to Romanian construction standards
  • Support in facilitating worker visas and work permits
  • Logistical coordination and support for worker relocation

3. Client Responsibilities

As a client of AfriTech Labor Company, you agree to uphold certain responsibilities to ensure the smooth operation of services provided:

  • Ensure a safe and compliant work environment for the laborers
  • Provide necessary tools, equipment, and training specific to the tasks at hand
  • Adhere to local labor laws and regulations in Romania
  • Provide appropriate accommodation and welfare provisions for workers, where applicable

Failure to comply with these responsibilities may lead to suspension or termination of the agreement.

4. Payment Terms

Payment for services rendered by AfriTech Labor Company must be made in advance as per the mutually agreed contract terms. The payment schedule will be outlined at the time of the contract signing, and late payments may incur additional fees. Accepted methods of payment include bank transfers, credit card payments, or other methods as mutually agreed. All fees are subject to VAT as applicable under Romanian law.

5. Worker Rights and Benefits

AfriTech Labor Company is committed to ensuring that all workers are treated fairly and in compliance with international labor standards. Workers placed by our company are entitled to the following:

  • Fair wages and compensation as per the agreed terms
  • Accommodation and transportation benefits as agreed
  • Health and safety protections as per Romanian law
  • Access to grievance procedures and conflict resolution mechanisms

6. Confidentiality and Data Protection

Both parties agree to maintain confidentiality regarding any sensitive information shared during the course of this agreement. This includes, but is not limited to, business strategies, worker personal information, and client details. AfriTech Labor Company adheres to GDPR (General Data Protection Regulation) guidelines to ensure the protection of personal data, and all data will be handled in strict confidence and with due care.

7. Limitation of Liability

AfriTech Labor Company will make reasonable efforts to ensure that workers are adequately trained and suited for their tasks. However, we will not be liable for any damages, injuries, or losses incurred during the course of employment. Clients are encouraged to provide insurance coverage to protect themselves and the workers against unforeseen circumstances.

Our liability is limited to the value of the services provided as stipulated in the contract. We will not be held responsible for any indirect or consequential losses.

8. Termination of Agreement

Either party may terminate the agreement in writing with a 30-day notice. Termination may occur if either party fails to adhere to the terms of the contract. In the event of termination, the client must settle any outstanding payments for services rendered up to the date of termination.

9. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of Romania. Any disputes arising out of or in connection with the services provided by AfriTech Labor Company shall be subject to the jurisdiction of Romanian courts. Both parties agree to seek amicable solutions through mediation before pursuing legal action.

10. Amendments to Terms

AfriTech Labor Company reserves the right to modify these Terms and Conditions at any time. Clients will be notified of any amendments, and continued use of the services will be considered as acceptance of the updated terms. It is recommended that clients review these terms periodically to stay informed of any changes.
